Welcome to the Underground Arcade! Our goal is to provide a fun and safe environment for all of our visitors. Please take a moment to read our Terms and Conditions before using our services.

Acceptance of Terms: By accessing or using The Underground Arcade's facilities, you agree to be bound by these Terms and Conditions, as well as any applicable laws and regulations. If you do not agree with any part of these terms, you may not access or use our services.
Age Requirement: The Underground Arcade is intended for use by individuals aged 17 and above. Individuals under 17 must be accompanied by a parent or guardian to access our facilities. Our NDIS Services are strictly for ages 12 and above under a schedule of supports.
Use of Facilities: The Underground Arcade provides access to gaming equipment, including but not limited to consoles, arcade machines, and tabletop gaming materials. Users must follow all posted rules and instructions while using our facilities. Whilst using some gaming devices users may have access to exterior websites or other gaming communities. The Underground Arcade accepts no liability for content accessed or received from parties exterior to our governance.
Respectful Conduct: Users are expected to treat staff and other patrons with respect and courtesy at all times. Any form of harassment, discrimination, or disruptive behavior will not be tolerated and may result in immediate removal from the premises.
Liability: The Underground Arcade is not liable for any exterior web content, injuries, damages, or losses incurred while using our facilities. Users are responsible for their own actions and belongings while on our premises.
Privacy Policy: The Underground Arcade may collect personal information from users for the purpose of providing services and improving our facilities. This information will be handled in accordance with our Privacy Policy.
Intellectual Property: All intellectual property rights related to The Underground Arcade, including but not limited to logos, branding, and gaming content, are owned by The Underground Arcade. Users may not reproduce, distribute, or use any of our intellectual property without prior written consent.
Modification of Terms: The Underground Arcade reserves the right to modify or update these Terms and Conditions at any time without prior notice. Users are encouraged to review these terms regularly for any changes.
Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of Australia. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Australia.

The Underground Arcade Giveaway - Terms and Conditions

1. Promoter Details

The promoter of this giveaway is The Underground Arcade (hereinafter referred to as “the Promoter”) located at 67-73 The Boulevard, Toronto NSW 2283.

2. Eligibility

The giveaway is open to all residents of New South Wales, Australia, aged 15 years or over, unless otherwise specified.
Employees of the Promoter and their immediate family members are not eligible to enter.
Entrants under 18 years of age require parental/guardian permission.

3. Entry Conditions

Entry is free and is conditional upon agreeing to these terms.
To enter, participants must successfully sign up to our NDIS Program of Supports for a minimum of 3 months; between Oct 27th 2024 - Dec 19th 2024, or, successfully refer a participant that signs up to our NDIS Program of Supports between Oct 27th 2024 - Dec 19th 2024.
Only one entry per person is allowed unless stated otherwise.
All entries must be submitted and successfully signed up by December 19th 23:59 AEDT 2024.

4. Giveaway Period

The giveaway will commence on Oct 27th 2024 and close at Dec 19th 23:59 AEDT 2024.

5. Prize Details

The total prize pool is valued at under AUD $10,000 and a Trade Promotion Permit is not required.
There are 3 prize(s) that will be given away, which include a choice of: 1) Sony PlayStation 5. 2) Warhammer 40K Combat Patrol or Age of Sigma Spearhead. 3) Game Master R36s Handheld Console.
The Promoter reserves the right to substitute any prize of equal or greater value if an advertised prize is unavailable.

6. Winner Selection

The winners will be selected at random on Dec 20th at 10:00am AEDT 2024 at The Underground Arcade.
Winners will be notified by email, phone, or in person within 5 days of the draw.
If a winner does not respond within 5 business days of notification, the prize will be forfeited, and the Promoter may redraw.

7. Prize Collection

Prizes must be collected from The Underground Arcade within 30 days of notification.
Identification matching the entry details will be required to collect the prize.
If the winner is under 18, a parent or guardian must be present at collection.

8. Publicity

By entering, participants consent to the Promoter using their name, likeness, and entry for promotional purposes without further compensation, unless prohibited by law.

9. Liability

The Promoter will not be liable for any loss, damage, or injury resulting from participation in the giveaway or acceptance of the prize, except as required by law.
Any costs associated with entering the giveaway or claiming the prize are the responsibility of the entrants.
The Promoter reserves the right to disqualify entries it believes to be fraudulent or non-compliant with these terms.

10. Privacy

The personal information provided by entrants will be used solely for the purpose of administering this giveaway.

11. Governing Law

This giveaway is governed by the laws of New South Wales, and entrants agree to submit to the jurisdiction of the NSW courts.
